Terms and Conditions

I wish to participate in the Whopp! 3-Point shot tournament offered by WhoppSports.com which will also be known as the Tournament.

As a precondition to participating in the tournament, I have read the following Release Agreement (the “Agreement”) and agree to its terms.

Qualification:
The Whopp! 3-point shot basketball tournament is open to any adult 18 years of age at the enrollment period of this agreement. Participants will acknowledge that this tournament will be a 3-point top-of-the-straight line shot from a distance of 24ft from the goal and not your typical side-middle-side 3-point shooting contest.

Divisions:
The Tournament will consist of four divisions Men, Women, Men 60plus years of age and Women 60plus years of age. Contestants in each division will compete against common opponents such as men against men, women against women, senior men against senior men and senior women against senior women. All contestants agree to participate in the assigned male and female divisions with the gender given to them at birth.

Contest structure/ Tournament Rules:
The Whopp! 3-point shot tournament will consist of the following breakdown. Each participant must qualify to advance to round one against other opponents by making at least one shot in the prequalifying round which will consist of each competitor making at least one 3-point shot from a distance of 24 ft from the goal. If the contestant makes a shot he or she will be allowed to advance to the first round to compete against a common opponent in their assigned division.

Tournament Rounds:
There will be numerous tournament rounds depending on the number of participants participating in the contest. Players who pass the qualifying round will participate in a first round paired up against others in their division and will be standing side-by-side next to his or her competitors. Competitors one and two. In round one or any rounds thereafter, the competitor of any division or round shoots and makes his or her 3-point shot, the second competitor will also have the opportunity to make a shot as well. If competitor two misses his or her shot then competitor two will be eliminated from the competition.

If both competitors miss their opening shots then competitor one will have a second chance to make a basket. If he or she makes the second shot then competitor two will also have the opportunity to do the same in order to remain in the competition. However, if competitor one misses his or her shot on the second try and competitor two makes his or hers then competitor one will be eliminated from the contest. If each competitor does not make a three-point shot in a total of five tries each in a round, then both competitors can be eliminated by the scorekeepers or head tournament officials. This elimination format will be used throughout the divisions and tournament rounds. In the case of an odd-numbered person meaning a person that cannot be evenly paired with a contestant because of a lack of competitors, Whopp Sports staff will make a qualifying and fair format for the player that is equally as challenging for the competitors who competed in the prior rounds.

High School / NCAA Student-Athletes:
This is a pay-for-play tournament. If you are a high school or college student-athlete, it is highly recommended that you check with your governing body to ensure that you don’t violate any NCAA rules that could possibly jeopardize your eligibility for participating in college sports. Whopp Sports does not precheck the status of any applicant. It is up to each high school and or college and University student wanting to participate in our tournament to contact your institution of learning to make sure that you are deemed eligible if you participate in this event. Even if you don’t win any prize money you could still be putting your student-athlete status at risk, so make sure you find out beforehand.

COVID-19 Protocol:
All participants must adhere to COVID-19 protocol in the event if such protocols exist at the time of our event. If for some reason we cannot host our event on June 28, 2024, because of a COVID-19 shutdown, then the event will be rescheduled for another date when allowed to do so. Enrollees in this event will not be entitled to a refund due to a COVID-19 shutdown. The contest will be rescheduled.

Tournament Prize Money
The prize money for the Whopp! 3-point shot tournament is urgently sent at a total of $5,000. 500 dollars will be paid to each of the four division winners who will then be allowed to compete for the $3,000 tournament grand prize. A minimum of 300 contestants must enroll in the tournament in order to achieve this payout structure. If less than 300 participants enroll to compete in the tournament Whopp Sports reserves the right to decrease the payouts to no less than $1,400 one hundred for each division winner and $1,000 to the overall winner. If more than 300 competitors enroll in the tournament, then Whopp Sports also reserves the right to increase the $5,000 payout at the company’s discretion.

Assumption of Risk.
Though small, I understand that participating in the tournament entails inherent risks of physical injury, including general injuries associated with playing the game of basketball.

Having read this form, I am fully aware of the risks and hazards associated with the Activity, and hereby elect to voluntarily participate in the Activity. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, that may be sustained by me as a result of participating in the Activity, unless caused by the gross negligence or willful misconduct of the staff, its officers, trustees, agents, employees or volunteers (collectively referred to as the “Whopp Sports”).

Liability Release.
In consideration for Whopp Sports allowing me to participate in the Activity, I agree I will not sue Whopp Sports and I release Whopp Sports from any and all liabilities, claims, demands, actions, causes of actions, costs and expenses of any nature whatsoever arising out of any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, arising from the Activity or while upon the premises where the Activity is being conducted, excepting those claims arising from the gross negligence or willful misconduct of Whopp Sports.

Indemnification.
I agree to indemnify and hold harmless Whopp Sports from and against any loss, liability, damage or costs, including court costs and attorneys’ fees, that Whopp Sports may incur arising from my involvement in the Activity, excepting those claims arising from the gross negligence or willful misconduct of Whopp Sports.

Warranty of Physical Fitness
I warrant that I am physically fit and in a condition that will allow me to participate fully in the Activity. I understand Whopp Sports has not made, nor will make, any investigation into my physical fitness or ability to participate in the Activity, and Whopp Sports is relying on my warranty of my physical condition. I assume full responsibility for payment of medical expenses not covered by my insurance incurred as a result of my participation in the Activity.

I understand and agree that Whopp Sports assumes no responsibility for any injury or damage that might arise out of or in connection with such authorized emergency medical treatment. Intent: It is my express intent that this Agreement shall bind the members of my family and spouse (if any), my estate, heirs, administrators, assigns, and personal representatives. I agree that this Agreement and any claim arising from my participation in the Activity shall be construed in accordance with the laws of the State of California, without regard to its conflict of laws provision.

The terms of this Agreement shall be severable, such that if a court of competent jurisdiction holds any term to be illegal or unenforceable, the validity of the remaining portions of shall not be affected thereby.

As an enrollee/participant to compete in Whopp! Sports 3-point shot basketball tournament, I acknowledge that I have read this Release Agreement form, understand it, and agree to be bound by its terms. I further acknowledge that I signed this Agreement voluntarily and I am at least 18 years of age during the time of registration.
